These Terms of Use (“Terms”) govern your use of the CertifyPAT app and related services provided by Certify Apps (“we”, “us”, “our”). By using CertifyPAT, you agree to these Terms.

1) Service

CertifyPAT helps users record in-service inspection and testing data, manage assets, and generate/export PAT certificates and related records.

2) Eligibility and account

  • You must be legally able to enter into a contract to use the service.
  • You are responsible for keeping your login credentials secure.
  • You are responsible for all activity under your account.

3) Subscriptions and billing

  • Some features require a paid subscription.
  • Subscriptions are billed through Apple App Store or Google Play.
  • Renewals, cancellations, upgrades, and downgrades are managed by the relevant app store billing system.
  • Payments are non-refundable except where required by law or store policy.
  • We may change pricing for future billing periods, subject to store/platform rules.

4) Acceptable use

You agree not to:

  • Use the service for unlawful, fraudulent, or harmful activity.
  • Interfere with service security, stability, or operation.
  • Attempt unauthorized access to systems or data.
  • Upload malicious code or abuse platform APIs.

We may suspend or terminate accounts for misuse.

5) Your data and content

  • You retain ownership of data you enter.
  • You grant us permission to process that data to provide, secure, and improve the service.
  • You are responsible for the accuracy and legality of your uploaded/entered content.
  • You are responsible for maintaining your own compliance and record-keeping obligations.

6) Compliance and professional use

CertifyPAT is a software tool and does not replace professional judgment, legal compliance duties, or required competency standards.
You are responsible for ensuring your inspections, reports, and certificates meet applicable laws, standards, and client requirements.

7) Availability and changes

  • We may update, modify, or discontinue features at any time.
  • We do not guarantee uninterrupted or error-free availability.
  • Planned and unplanned downtime may occur.

8) Intellectual property

All rights in the app, software, branding, and materials (excluding your own content) are owned by Certify Apps or licensors.
You must not copy, reverse engineer, resell, or distribute the service except as permitted by law.

9) Disclaimers

The service is provided “as is” and “as available” to the maximum extent permitted by law.
We do not warrant that outputs are complete, error-free, or suitable for every specific compliance scenario.

10) Limitation of liability

To the maximum extent permitted by law, Certify Apps is not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, contracts, or business opportunities.
Our total liability for claims relating to the service is limited to the amount you paid for the service in the 12 months before the claim.

Nothing in these Terms excludes liability that cannot legally be excluded.

11) Termination

You may stop using the service at any time.
We may suspend or terminate access for breach of these Terms, security risk, legal requirement, or non-payment where applicable.

12) Governing law

These Terms are governed by the laws of England and Wales, and disputes are subject to the courts of England and Wales, unless mandatory local law provides otherwise.
