Terms of Use

These terms govern your use of the CertifyApps website and any Certify app or service that expressly links to them. Please read them before using the website, creating an account or subscribing.

2. Scope of these terms

These terms apply to:

• www.certifyapps.co.uk;
• contact, trial, demo, support and subscription-enquiry services; and
• a Certify app or service that expressly links to these terms.

An individual app may provide additional product terms, store terms, a privacy notice or an order description. Those specific terms also apply. If there is a conflict about a product-specific feature, the more specific product or order term takes priority.

For example, CertifyPAT publishes its own Terms of Service.

Apple App Store and Google Play also apply their own terms to downloads, purchases, renewals, cancellation and refunds processed through their stores.

Nothing in these terms limits a statutory right that cannot lawfully be limited or excluded.

3. Accepting these terms and eligibility

By using a service that links to these terms, you agree to them. If you do not agree, do not create an account, subscribe or continue using that service.

CertifyApps is designed for adults carrying out business and professional workflows. You must be at least 18 years old. If you use a service for an organisation, you confirm that you are authorised to act for that organisation and to accept applicable terms on its behalf.

4. What CertifyApps provides

CertifyApps provides software tools for creating, managing and exporting trade and professional records. Depending on the app, this may include customer and site records, asset registers, inspections, test results, certificates, reports, labels, reminders and document exports.

The features available depend on the app, platform, plan, entitlement and version. Product pages and the purchase screen describe the features included at the time.

5. Professional responsibility

CertifyApps provides record-keeping and document-generation tools. It does not replace competent inspection, testing, risk assessment, training, supervision or professional judgement.

You are responsible for:

• being competent and appropriately authorised for the work you perform;
• following applicable laws, standards, guidance, scheme rules and customer requirements;
• choosing and carrying out the correct inspection or test;
• checking all measurements, classifications, results and dates;
• reviewing every certificate, report, label and export before issuing or relying on it; and
• correcting errors promptly.

The app does not certify your competence or guarantee that a record satisfies every legal, regulatory, contractual or scheme requirement.

6. Accounts and authorised users

You must provide accurate account information and keep it current.

You are responsible for:

• keeping passwords, sign-in links and device access secure;
• using only authorised accounts and user seats;
• promptly removing access that is no longer required; and
• telling us promptly if you suspect unauthorised access.

Do not share a personal sign-in in a way that bypasses plan limits or security controls. An organisation is responsible for activity by users it authorises, except to the extent an incident was caused by our failure to use reasonable care.

We may require account verification, email confirmation or additional security steps.

7. Your records and permissions

You retain ownership of the customer, site, equipment, inspection, certificate, branding and other content you enter or upload.

You give Sysress Limited a limited, non-exclusive right to host, copy, process, transmit, back up and format that content only as needed to provide, secure, support and improve the service or comply with law.

You confirm that:

• you have the right and lawful basis to enter, use, store and share the information;
• the content does not infringe another person’s rights;
• you will not upload unnecessary sensitive information; and
• you will handle customer and worker information in accordance with applicable data-protection law.

The organisation using the service is normally responsible for deciding why customer, site, worker and professional-record information is processed.

8. Free access, trials and paid plans

Where offered, an app may be free to download and may include a limited, genuinely usable free plan. Optional paid plans unlock additional limits, features or authorised-user capacity.

Before buying, the relevant app store or purchase screen will show the product, billing period, current price, applicable taxes, renewal terms and included features. Those details form part of the purchase terms.

A trial or promotional offer may have separate eligibility, duration and conversion terms shown before acceptance. We will not charge through the app unless the relevant store or purchase flow confirms the transaction.

We may change future plan features or prices, but changes will not remove rights you have already acquired for a paid billing period. Any renewal-price change will be handled through the relevant store and applicable notice or consent requirements.

9. Subscriptions, renewal and cancellation

Paid subscriptions ordinarily renew automatically for the period shown at purchase unless cancelled before renewal.

If you subscribed through Apple App Store or Google Play:

• the store processes payment;
• you can manage or cancel the subscription through the store account or the in-app subscription-management route where available;
• cancellation usually stops future renewal and paid access continues until the end of the current paid period, unless the store states otherwise; and
• deleting the app or your CertifyApps account does not by itself cancel the store subscription.

Where available, Restore purchases reconnects an eligible store purchase to the signed-in account. You must use the correct store account and CertifyApps account.

10. Refunds and statutory cancellation rights

Apple or Google normally handles refund requests for purchases made through its store, subject to that store’s rules and applicable law. Contact support if you need help identifying the correct route.

Nothing in these terms removes statutory refund, cancellation, cooling-off, quality or digital-content rights that apply to you.

If Sysress Limited later offers direct website payment, the purchase flow must state the relevant payment, renewal, cancellation and refund terms before the order is placed.

11. Exports, backups and record retention

You must check PDFs, CSV files, calendar files, labels and other outputs before sending them to a customer or relying on them.

Keep suitable independent copies of records that are important to your business or required by law, a scheme or a customer. Although we use reasonable measures to protect and back up supported cloud services, no online service can guarantee uninterrupted access or permanent error-free storage.

Export records you need before closing an account or losing access to a paid feature.

12. Acceptable use

You must not:

• use the service unlawfully, fraudulently or to create misleading records;
• access or attempt to access another user’s or organisation’s information without authority;
• bypass account, plan, entitlement, seat, rate or security controls;
• upload malware or content intended to damage, overload or disrupt a service;
• probe, scan or test security without our written permission;
• reverse engineer restricted parts of a service except where applicable law expressly permits it;
• copy, resell or make the service available as a competing product without permission;
• infringe intellectual-property, confidentiality, privacy or data-protection rights; or
• claim that CertifyApps, Sysress Limited or a third party has certified, approved or endorsed work when it has not.

Reasonable API, import, export and automation use must follow the documented workflow and must not harm service availability or other users.

13. Intellectual property

Sysress Limited and its licensors own the CertifyApps services, software, designs, documentation, branding and website content, excluding content you own.

We grant you a limited, revocable, non-exclusive and non-transferable right to use the service for its intended business purpose while you comply with these terms and hold any required entitlement.

App-store and open-source components remain subject to their applicable licences. These terms do not transfer ownership of the service or its intellectual property.

Feedback may be used to improve the services without payment, but we will not identify you publicly as its source without permission.

14. Availability, updates and changes

We aim to provide a reliable service but do not promise uninterrupted, delay-free or error-free availability. Maintenance, security incidents, provider outages, device restrictions, internet failure or app-store processes may affect access.

We may provide fixes, security updates and feature changes. You should install supported updates promptly. An old version may stop working where continued operation would create a security, legal or compatibility risk.

If we make a material adverse change to a paid service, we will give reasonable notice where practicable and honour applicable statutory and store rights.

15. Suspension and termination

We may restrict or suspend access where reasonably necessary to:

• address a security risk or suspected unauthorised access;
• investigate unlawful use, fraud or a serious breach of these terms;
• protect users, third parties or the service;
• comply with law, a court order or an app-store requirement; or
• address an unpaid direct charge, if direct billing is introduced.

Where appropriate, we will explain the reason and give you a reasonable opportunity to remedy the issue.

You may stop using a free service at any time. You may request account deletion through the relevant app or public deletion page. Account deletion and subscription cancellation are separate actions.

Terms that by their nature should continue—such as ownership, payment already due, record responsibility, liability and dispute provisions—survive termination.

16. Third-party services and links

The service may interact with app stores, authentication providers, cloud hosting, subscription management, email, calendar, file-sharing, maps or other third-party services. Their own terms and privacy policies apply to their services.

We are not responsible for a third-party service outside our control, but this does not affect responsibility we cannot lawfully exclude for our selection, configuration or use of a processor.

17. Warranties and liability

We provide the service with reasonable care and skill. Statements on the website about planned products, roadmap items, early access or expressions of interest are not promises that a feature will be released on a particular date.

To the fullest extent permitted by law, we are not responsible for:

• professional decisions, inspections or tests carried out by a user;
• an inaccurate, incomplete or unchecked record or export;
• loss caused by use outside the documented purpose or contrary to these terms;
• a third-party, device, network or app-store failure outside our reasonable control; or
• indirect or consequential loss that was not reasonably foreseeable.

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, breach of rights that cannot lawfully be excluded, or any other liability that law does not permit us to limit.

If you are a consumer, these terms do not affect your statutory rights. If you use the service wholly for business purposes, liability may also be governed by product-specific or order terms agreed with your organisation.

18. Privacy

Our Privacy Policy explains how we handle personal information. Product-specific notices provide more detail for individual apps.

19. Changes to these terms

We may update these terms to reflect service, security, legal or regulatory changes. The latest version and update date will be published here.

We will give reasonable notice of a material change affecting an active paid service where practicable. A change does not retrospectively remove statutory or contractual rights already accrued.

20. Governing law and disputes

These terms are governed by the laws of England and Wales.

If you use the service for business purposes, the courts of England and Wales have exclusive jurisdiction, unless product-specific terms state otherwise.

If you are a consumer, you may also have the right to bring a claim in the part of the United Kingdom or other country where you live, and mandatory local consumer protections continue to apply.
